Terms of Sales
Preamble
The aristide-collection.com website (hereinafter "the Site") is an e-commerce site accessible through the Internet, open to any user of this network. It is published by the company Aristide, a company (hereinafter referred to as Aristide), SARL with a capital of 7500 Euros, whose registered office is 785, Chemin du Mas Vedelin 30900 Nîmes - France, registered with the Register of Commerce and Companies of Nîmes under number 520 103 383 00011, VAT number FR74520103383.
The Site allows ARISTIDE to offer for sale most of its products (hereinafter "the products") to non-professional buyers who are consumers, being over the age of 18 years and having full legal capacity (cf. -after "the Clients").
These General Conditions of Sale (hereinafter "GTC") govern the relations between the ARISTIDE Company and Customers wishing to make a purchase or browse the Site. Any order for a product offered on the Site implies the full and complete adhesion of the Customer to these Terms and Conditions.
In case of modification of these Terms, the applicable GTC are those in force on the date of the order.
The command
Any resale of products purchased on the Site is strictly prohibited. As such, each order is limited to a total of 30 (thirty) items maximum.
Any order will be validated only after acceptance of the payment.
ARISTIDE agrees to honor orders received within the limits of available stocks and in case of unavailability to inform the Customer by any means whatsoever; the Customer may then cancel the order and be reimbursed, if necessary, the sums already paid. ARISTIDE reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over the payment of a previous order.
Acknowledgment of receipt of the order
At the end of the payment, a summary document of the order is sent by ARISTIDE to the Customer, by e-mail to the e-mail address indicated, immediately and at the latest before delivery.
This document acknowledging receipt of the Customer's order includes all the elements of the contract between the parties.
The purchase order is registered on ARISTIDE's registers, which are themselves kept on a reliable and durable support. The customer accepts that the purchase order is considered as proof of the contractual relations between the parties.
The customer will have the opportunity to print the summary order form sent with the acknowledgment of receipt. The summary of the order will also be available on the Site in the "My Account" section.
The customer can follow at any time the evolution of his order on the Site in the "My Account" section or contact the Customer Service by email: contact@aristide-collection.com for any other question related to his order.
Modes of delivery
ARISTIDE delivers its products all over the world. The products will be shipped to the delivery address indicated by the Customer when ordering (excluding Mailbox).
Delivery date
ARISTIDE agrees to deliver the Customer within the indicated deadlines before validation of the order and subject to the payment. In case of late delivery of more than 7 working days, if the product has not been shipped, the Customer may terminate the order by registered letter with acknowledgment of receipt and request the refund of his order.
If the item was shipped before receiving the cancellation of the order for late delivery of more than 7 days, ARISTIDE will proceed to the refund of the item and the costs of shipping and return, upon receipt of it , complete, in its original state and with all labels.
ARISTIDE undertakes to inform the Customer of the progress of the processing of his order.
ARISTIDE can not be held responsible for delays in delivery caused by the occurrence of events of force majeure and strike.
The prices
Prices shown are expressed in euros and include all taxes, excluding shipping costs, which are the responsibility of the Customer. Any change in the applicable VAT rate will automatically be reflected in the prices of the items as soon as they come into effect. ARISTIDE does not refund any difference between the prices displayed on the website and the prices displayed in the store.
Payment terms
The full payment must be made when ordering. At no time the sums paid can not be considered as a deposit or installments. The Customer pays his order by credit card (Visa, Eurocard / Mastercard) in accordance with the provisions of this article, or by bank transfer.
For any transaction, the Customer will indicate the number on the front of his card, the expiry date of his card and the cryptogram on the back of his card (last three digits).
The communication by the Customer of his credit card number is authorizing ARISTIDE to debit his account for the amount of his order.
No sending in cash on delivery will be accepted, whatever the reason.
ARISTIDE retains the property of the article until full payment of the price by the Customer. Purchases are made securely. The payment solutions adopted by ARISTIDE are 100% secure. For payments by credit card (credit card, blue card visa), BNP PARIBAS is responsible for securing payments. All information that Clients communicate to ARISTIDE is strictly protected and guarantees the conformity and security of each transaction.
In addition, to fight against fraud, ARISTIDE has set up a system implementing exclusion lists, which can lead to:
(I) claim, in order to secure the transaction, certain supporting documents once the payment has been made, in the event of an automatic alert triggered by the information relating to the order.
(II) block any order from a Customer account previously causing fraud.
Intellectual property rights
All texts, comments, photos, trademarks, graphics, concept, illustrations and images on the Site are the exclusive property of ARISTIDE and are protected by intellectual property rights in France and throughout the world. Any total or partial reproduction of the Site is strictly prohibited.
Satisfied or refunded
The essential characteristics of the articles are presented on aristide-collection.com in each of the article sheets. The Customer is fully aware that the images, photos and colors of the items offered for sale may not correspond to the actual colors under the effect of the Internet browser of the screen used.
The Customer, if he is not satisfied, has a period of fifteen days from the date of dispatch to return it and obtain the refund of sums already paid. This period includes the statutory withdrawal period of seven days provided for in Articles L121-20 and following of the Consumer Code.
The item must be returned in new condition, in its original packaging and accompanied by the return slip sent by email by ARISTIDE customer service, to the address indicated on this return form.
In the absence of a return receipt, ARISTIDE can not refund the returned items.
Items returned incomplete, damaged, damaged, worn or soiled will not be returned.
The returned item will be refunded to the Customer within a maximum of thirty days from receipt by ARISTIDE. It is the Customer's responsibility to keep any proof of return, ie a return by registered parcel or by any other means giving a certain date to its sending.
The refund will be made by a credit of the amount to be refunded on the Customer's bank account debited during the transaction (excluding shipping costs related to the return package).
The legal right of withdrawal and the guarantee "satisfied or refunded"
Default of the article
ARISTIDE is responsible for the lack of conformity of the product with the order and latent defects under the conditions provided for in articles 1641 and 1649 of the Civil Code. In accordance with the provisions of the ordinance n ° 2005-136 of February 17th, 2005, the articles of the Civil Code mentioned above as well as the articles of the Code of the consumption relating to the guarantee of the goods of consumption are reproduced in the present GSC.
Nominative data
The personal data collected on the site aristide-collectioncom are necessary to the processing of the order and more generally to the management of the commercial relations of ARISTIDE with its Customers and are intended for ARISTIDE.
To make purchases on the Site, the Customer must create an account, choose an e-mail address and a password that will be requested each time he wishes to access it. The personal information of the Customer is thus protected by a password so that the Customer, and he alone, has access. ARISTIDE recommends that the Client disclose it to no one. The Customer must also disconnect from his profile and close his browser window after each work session, particularly in the context of the use by the Client of collective computer equipment. The Customer will avoid that users will access his personal information. The Customer is solely responsible for the confidentiality of his password. The Customer alone will bear the consequences of any fraudulent use of his password.
In accordance with the law of January 6, 1978, the Customer has a right of access to personal data concerning him that he can exercise in writing to the Customer Relations Department and this, without prejudice to the right he also has s oppose to the aforementioned conditions to the use of his personal data for purposes of commercial solicitations by ARISTIDE alone or in partnership with other companies and / or directly by third parties, companies transferring said personal data.
Applicable law and competent jurisdiction
These Terms are subject to French law. In case of dispute exclusive jurisdiction is assigned to the competent French courts, notwithstanding plurality of defendants and / or warranty claim even for emergency procedures or provisional proceedings in summary or by motion.
Reproduction of Articles L211-4 L211-5 and L211-12 of the Consumer Code
Article L211-4:
The seller is required to deliver a good in accordance with the contract and is liable for any lack of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, the assembly instructions or the installation when it has been charged to it by the contract or has been carried out under its responsibility.
Article L211-5:

Article L211-12:
The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods
Reproduction of Articles 1641 and 1648 AL 1 of the Civil Code
Article 1641:
The seller is bound by the guarantee by reason of the hidden defects of the thing sold which render it unsuitable for the use for which it is intended, or which diminish the use so much, that the buyer would not have acquired it, or not would have given a lower price, had he known them.
Article 1648:
The action resulting from the latent defects must be brought by the purchaser within two years from the discovery of the defect.
